Does My Company Have Any Liability If Someone gets Sick from the Food We Donated?

Not at all! The Bill Emerson Good Samaritan Food Donation Act protects food donors from liability for food donated to a nonprofit organization in good faith. In most cases, these laws have improved the quality of food consumed by people experiencing food insecurity, and have generally protected donors.


In donating your food, Dishefs assumes any liability. Additionally, our food rescuers and participants are trained in food safety. Click here for more information about liability.

Is it possible to pick up from my private residence?

Currently, we do not pick up from private residences.


The surplus food can only be collected from a non-commercial entity if it is prepared and stored in a commercial kitchen. We cannot collect surplus food prepared at private residences.


Some of our nonprofit partners prepare meals that they distribute individually to their beneficiaries. Sometimes, they can’t serve all the meals. As they use a commercial kitchen, we can accept their donations for redistribution to other nonprofit partners.
